Sunday oct. 10 4:00 am  

Adlen is found lying unconscious on sidewalk by a policeman on his way to the police station. (at the beginning, Kheira was said to have been found lying on the sidewalk, then on the street itself).

 

Sunday oct. 10  6:48 am 

The rescue brigade (firemen), alerted by the police, drives Adlen still unconscious to the emergency room at Bichat Hospital (Paris 18°).

  • Why did it take so long -2h48- for him to be taken to the hospital ?.
  • Why did not the policemen called Kheira ? (They knew her phone number as she had called them the night before at 10:30 ! Also, they probably copied all Adlen's data when he was arrested the day before).

 

Sunday oct. 10  7:02 am  

Adlen's arrival in the emergency room at Bichat Hospital is recorded at 7:02 am.

 

Monday oct. 11  9:11 am  

Kheira's mobile phone memorized her call to the Tribunal de Grande Instance (High Proceedings Court). She gets confirmation of Adlen's notification to attend on nov. 4th 2005, 9:00am at the TGI, chamber 28. It is supposed to be normal that this procedure between the police station and the TGI takes place over the phone. (We are puzzled).

 

Monday oct. 11  11:00 am (approx)  

Kheira is finally informed of Adlen's presence in Bichat hospital and of his critical condition. Kheira is pressed to attend the hospital and is told to be there as soon as possible to finalise the protocol. (Protocol! What protocol?). Kheira is stunned when they broke the news to her and is hard hit, to say the least...(later on she gathered that they were on about organs removal. What a tactful way of giving bad news of a loved one to such a close family member!).

  • Why did it take so long - 28h ! - to give a call to the family ?

We understand that in calling Kheira, the hospital did not care about Adlen but was only interested by the organs removal protocal.  (No comment).

 

Monday oct. 11  1:00 pm (approx)

After a full hour standing in the waiting room (!), the intern (doctor) consents to detail the desperate condition of Adlen. He is in a deep coma caused by two cerebral ematomas; he also has recent contusions on the legs. The intern does not leave much hope for Adlen's recovery. Kheira is informed that the firemen had driven Adlen... the day before.

 

Monday oct. 11  3:00 pm 

At the police station, Kheira is told that a police patrol found Adlen (saturday 4:00 am), sleeping in his van (Therefore, he was not driving). The policemen asked him to move his van. Then, since his car seemed to have hit something (trash can,… ?), they decided to proceed to an alcool test (important: it was 4am). These very policemen are the ones who told Kheira (and her sister in law) in detail how difficult it was for Adlen to blow in the breathalizer (remark: Adlen having a heart condition was taking medication... it seems normal that he had breathing difficulties) .This is when they decided to drive him to the police station.

Remarks:

  • The arrival time of Adlen in the police station is not mentionned anywhere.
  • We never heard of anyone arrested for 0,7g/l.  In such a case your driver license maybe confiscated perhaps also the car keys are habitually confiscated and you're told to take a cab or the subway back home!

 

Wednesday oct. 13   

Kheira chooses Maître Prévost-Bobillot to be her lawyer.

 

Thursday oct. 14        

Maître Prévost-Bobillot lodges a complaint against "person or persons unknown for beating and wounding Abdelhafid Rouag" to the Attorney General.

The Attorney opened a judicial procedure that same day and seized the IGS (Police of Police).

Right away, the IGS launches its own investigation on the behaviour of the people at the 17th arrondissement police station.

 

Friday oct. 15   

By chance, Kheira finds in her mailbox a notification to attend an interview, the same day 3pm, at the IGS building (the document was simply dropped-off in her mailbox ).

Friday oct. 15 3:00 pm 

Surprisingly, Kheira has to share the same waiting room as a police employee from the incriminated police station. (He must be impatient since he is already there at 3 pm while his appointment is for 5 pm).

 

Friday oct. 15 6:45 pm
 

 Mr Abdelhafid Rouag is declared dead by the Bichat Hospital.

A medical certificate written upon request of a OPJ (Officer of Judiciary Police) is given to Kheira. Based on the procedure, the General Attorney will modify the words of the former complaint (oct 14) in adding  "...willingly or unwillingly  causing death"

 

Saturday oct. 16 11:15 pm  

Adlen's body is transfered to the Paris morgue (Institut Médico-Légal) for an  autopsy.

 

Tuesday oct. 21    

At the Algerian Paris consulate for obtaining required documents for sending Adlen's body to Algeria and passports update.

It must be mentionned that Kheira received a warm welcome from the consulate people, even offering psychological support for her kids. We thank them for their attitude which markedly contrasted with that of the french authorities.

On the same day, Kheira is informed that Adlen remain may be out in coffin making his burrial possible.

 

Tuesday oct. 21 3:30 pm 

At the Paris 18th city hall, reception of the certificate of death.

 

Tuesday oct. 21 4:00 pm

Same building. Meeting with Mrs Annick Lepetit (Member of Parliament for the area of the police station and the hospital Bichat).

She is shoked by Kheira's story and promises to alert her counterpart at Kheira's district. Also, she will inform Mr Daniel Vaillant (also Member of the Parliament and former Ministry of Interior).  We inform her that they should already know about since we had already written to them... without feedback.

 

Friday oct. 22  5:45 pm  

Call from the secretary of Mr Serge Blisko (Member of Parliament for Paris 13rd) scheduling a meeting with us. We had to pospone the date since Kheira with her kids would be dealing with the funeral in Algeria at that time.  (through that call we understand that A.Lepetit warned them).

 

Monday oct.25    

At the morgue (Institut Médico-Légal), Adlen's coffin is closed.  Adlen's body in flown to Algeria where he is burried next to his relatives in his native city, Skikda. 

 

Thursday oct. 27

After the hundreds of emails sent to politians of all (almost) parties, to the Paris 13 City Hall, to the Senate, to the media and (maybe) after our meeting with Mrs A. Lepetit (Socialist Party), Mrs Nicole Borvo (Vice-President of the Law Commission, President of the Republican and Citizen Communist Group, Senator of Paris) wrote this letter: (page.1) / (page.2) to the President Truche of the CNDS ( Commission Nationale de Déontologie de la Sécurité ) (known in France as Commission Truche) on request of our Collective Group. Mrs A. Lepetit and the media have been informed of that, this "saisine" has been refered to the CNDS.

Kheira visits the Algerian Embassy to ascertain what the Algerian authorities intend to do with regards to the suspicious death of her husband, Adlen being an Algerian subject as well as holder of the French citizenship (Dual nationality).
A senior official at the Embassy responds, "this is a matter for the Consulate".

Tuesday nov. 9th       
  • After his offfer to place a second "saisine" to the CNDS (nov.3rd), Kheira confirms her demand to Mr  Daniel Vaillant (Member of the Parliament, Socialist Party Deputy for Paris 18th, former Secretary of Interior) by mail (with acknowlegement).

Kheira makes an appointment and attends a meeting with a Consulate staff member.
Although during her initial visit she was met with compassion and sympathy while they renewed her passport and when papers relating to the formalities for the transfer of her husband's remains for his burial in Algeria were issued, this time the mood was somewhat different, especially when the Consulate official gathered that Kheira was seeking their support to uncover the truth about circumstances of the death of Adlen.

She is told in a firm way to "WAIT"! Apparently the Consulate is following the developments of the case, but we are just wondering how? What does this process of waiting entails? (Checking the daily French press? the Collective Support Group website?). She is told that they are waiting for the publication of the IGS's report, “Inspection Generale des Services(the internal French Police Complaints Authority). Kheira asks whether the Consulate has made a formal request to the French Prosecutor for a copy of this report? or are they assuming that they will automatically get a copy?

Frankly we are astonished to see that Algeria as a sovereign nation pays little interest to the death of its citizens abroad (Adlen held dual nationality)! The Consulate staff member adds "If by then nothing happens and we establish that there is nothing further that can be done... We will refer this matter to our Embassy".... Didn't the Algerian Embassy say "this is a matter for the Consulate?". From here, we can clearly anticipate that Kheira will be sent back and forth between these two Algerian state representatives, supposedly there to protect and assist their subjects abroad.

As for pursuing the case in a legal framework, Kheira is given this invaluable piece of advice, which is to seek legal aid from the French Legal Aid System (l'Aide Juridique Française). It is worth mentioning that this aid is linked to the resources of the claimant and can only be awarded to individual earning less that €830/month, following a new government directive which came into force on 1st January 2004.

Of course there is the alternative of using the Consulate’s appointed lawyer, however, if the latter turns out to be as ineffective as his colleague, then the Collective Support Group for Adlen would have to seriously contemplate helping Kheira financially.
 


 

Wednesday nov. 10th 
  • We are said that the first "saisine" placed by the Senator Nicole Borvo ( oct.  27th ) has been recorded at the CNDS .
  • Without news from the City Hall of Paris 13th after their initial offer for a date (oct 22), we leave different messages to the attention of Mr Serge Blisko   (Mayor, Member of the Parliament, Socialist Party Deputy for Paris 13th ).
Tuesday nov. 18th   
  • Kheira received a confirmation letter from Mr Daniel Vaillant. He placed a second "saisine" at the CNDS. Too bad ... he got confused and gave the police station address to Kheira ! We will make sure that the CNDS file is correct.
Monday nov 22nd
  • The Collective Support Group is said that Mrs Annick Lepetit (Socialist Party Deputy ) will place a third "saisine" at the CNDS.
Wednesday nov 24th
  • Reception of Mrs Annick Lepetit's letter mailed to the CNDS:    (french document page 1 / page 2 )
  • 1st meeting of Adlen Collective Support Group. (the meeting report has been sent to all our internet members on nov 28th, for our non-connected friends, we urge them to ask a friend for a copy...)  
Saturday nov 27th 
  • We have received a letter from the office of the Mayor of Paris, Mr Bertrand Delanoë, in which it is quoted that the Mayor's Office has been made aware of our endeavour and the office is displaying a "great deal of interest"...in our attempt to seek the truth.

    The paper is signed by Mr Philippe Lamy, (A member of the Advisory Board of the Mayor of Paris).

    According to the Mayor's office comments, or at least one of his advisors’, the Support Group has made the right approach by alerting the CNDS.

    Obviously, this statement does not carry much weight, but we thought it is worth bringing it to the attention of the Support Group.
